i. All bids are binding
Only bid if you are intending to purchase this car. Bids from users with negative feedback will be handled with discretion. All new users must call us prior to bidding.

Before placing your bid, please make sure you understand the following and clarify any questions:
- The vehicle specifics (model, options, etc.)
- The condition of the vehicle
- Terms of sale, including payment, additional dealer fees and shipping/pickup options.

If you cannot contact the seller through email, you can request their contact information and contact them by phone.

x. Notice to Bidders
Until the last 12 hours of an auction: If a vehicle is no longer available for sale, we reserve the right to cancel all bids and end an auction early.

Motorphilia does recognize that eBay will not let an auction end early if 12 hours remain and there is a successful bid over reserve -- If there is a successful bid over reserve during this 12 hour period, Motorphilia must allow the auction to run its course and cannot offer this vehicle for sale though any other venue. NO EXCEPTIONS ARE ALLOWED.

xi. Non-Paying Bidder
As the winning bidder, you and Motorphilia are entering into a legally binding contact. DO NOT BID IF YOU DO NOT INTEND ON COMPLETING THE SALE.

A person will be considered a "Non-Paying Bidder" their deposit is not received within 24 hours and/or if balance of their purchase is not paid in full within 7 business days following the close of auction. Certain exceptions can apply, but must be brought to Aaron Smith's attention before you decide to bid. If a person is a "Non-Paying" bidder, we reserve the right to re-list the vehicle or sell the vehicle to the next highest bidder or another qualified buyer. Along with the possibility of negative feedback and account suspension from eBay-- All non-paying bidders will be reported and legal action may be taken.

xii. This vehicle will be sold as equipped

ii. Reserve Price

Reserve Price is private and will not be disclosed. Bids on eBay are considered to be valid offers. If a bidder wishes to end an auction early, please call Aaron Smith at 512-296-7930 for further assistance. If there is a successful bidder over reserve in the last 12 hours of any auction, the auction can not be stopped for any reason or any offer -- the auction MUST run its course and the highest bidder will win -- this is eBay policy.

iii. Payment Methods
Cash, certified check, wire transfer, or USD-party financing. All funds must be in US dollars only. Please be sure to have full payment and/or approved financing in place before making your final bid. Call 512-296-7930 for more information.

iv. Shipping
The buyer is responsible for all shipping charges. We will assist the buyer with finding a shipping company - call 512-296-7930 for more information. We assume no responsibility for damages incurred after leaving our premises. If the vehicle is going to be shipped, full payment must be received before the vehicle is delivered to the shipping company. If you wish to pick the car up personally, this can be arranged -- please call if you have any questions.

vi. Buyer's Inspection
Every effort has been made to accurately and fairly describe this vehicle to you. Motorphilia has tried to disclose all information known about this vehicle for auction. Please be advised that used vehicles will have typical scratches and dings inherent for their year and mechanical parts are subject to fail. Motorphilia welcomes and recommends a buyer's inspection. If you plan to have a buyers inspection, please make sure you inspect the vehicle prior to the auction ending. Buyer is responsible for any inspection charges and fees.

vii. Payment of Balance Due
The buyer agrees to pay remaining balance due (plus applicable fees and taxes) within 7 business days of the close of the auction. All financial transactions must be completed before delivery of the vehicle. Additional Fees and taxes are not included. Out of state buyers are responsible for all state, county, city taxes and fees, as well as title/registration fees in the state that the vehicle will be registered

v. Deposit

The successful high bidder will submit a $1,000 non-refundable deposit within 24 hours of the close of the auction to secure the vehicle. This may be done via PayPal.

viii. Warranty
 Unless otherwise stated in the vehicle description, this vehicle is being sold "as is". No representations or warranties are made by seller, nor are any representations or warranties relied upon by bidders in making bids. Manufacturer's warranties may still apply. Extended warranties may be available; please contact us for details.

ix. Successful Bidder
The winning bidder will be contacted via email after the auction closes or he/she must contact Aaron Smith within 24 hours to proceed with payment and delivery arrangements.
